Do I Need a Party Wall Agreement for a Loft Conversion?

For most Worthing homeowners the answer is yes, and the reason is structural: a loft conversion nearly always relies on the party wall to hold it up. If you share a wall with a neighbour, which almost every terraced and semi-detached home in Worthing does, the Party Wall etc. Act 1996 is very likely to apply.

Why loft conversions trigger the Act

The Act gives you the right to use the party wall for your works, but you must notify your neighbour first. Loft conversions typically involve one or more of these notifiable activities:

Cutting into the party wall to insert the steel beams (RSJs) or timbers that carry the new floor and roof structure; raising or rebuilding the top of the party wall where the new roof meets it; and inserting flashings or weatherproofing into the neighbour's side of the wall. Each of these is work to the party wall, which means a party structure notice under Section 3, giving your neighbour two months' notice before work begins.

What that means in practice

You serve a party wall notice; your neighbour consents or dissents (or a non-response counts as dissent after 14 days); and if they don't consent, an impartial surveyor prepares a party wall award with a schedule of condition recording their property beforehand. That schedule is your protection: loft works involve hammering steels into a shared wall, and a proper before-record settles any later claim of cracked plaster quickly and fairly.

When it might not apply

If your property is fully detached with no shared wall, and the works don't involve excavation near a neighbour, the Act may not be triggered at all. But detached homes are the exception in Worthing's terraced streets, so it's always worth a quick check before you assume you're clear.

Get it moving early

The two-month notice period catches people out, it needs serving well before your builder wants to start, or it delays the whole project. If a loft conversion is on your plans, sort the party wall side early.
